Terms and Conditions

1. VALIDITY OF TERMS AND CONDITIONS OF SALE

1) These Terms and Conditions of Sale apply to the purchase of goods and services in the online store spekter.eu between the buyer (hereinafter the Client) and the company Finostilo OÜ (hereinafter the Online Store).
2) In addition to these conditions, the legal relationships arising from purchasing products from the online store spekter.eu are regulated by the Law of Obligations Act of the Republic of Estonia (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other applicable legislation.
3) The online store spekter.eu reserves the right to make changes to the Terms and Conditions of Sale. These changes will be published on the website spekter.eu.

2. PRICE INFORMATION

1) All prices listed in the online store spekter.eu are in euros and include 24% VAT.
2) In addition to the product price, a delivery fee will be added according to the delivery method selected by the Client during checkout. The delivery method is selected and the delivery fee is calculated in the shopping cart. For deliveries to parcel machines within Estonia, a shipping fee of €4.09 applies. For larger orders (over 50 cans), a separate transport quote will be provided. Goods may also be collected in person at the SPEKTER store at Tondi 8a, Tallinn. Delivery to the SPEKTER store is free of charge.
3) The transaction is subject to the conditions and prices valid at the time of the transaction.
4) Product selection, prices, and discounts in the Online Store may differ from the assortment, prices, and discounts of the company’s retail stores.
5) The Online Store spekter.eu reserves the right to make changes to sales prices and conditions. These changes will be published on the website spekter.eu.
6) The Online Store has the right to withdraw from a sale and request the return of goods from the buyer if the product price has been mistakenly listed significantly below the market price.

3. PLACING AN ORDER

1) Add the desired products to your shopping cart.
2) On the checkout page, fill in the required fields, select a suitable delivery method, and if you have a promotional code, enter it by clicking the text link “Click here to enter your code” and activating it by clicking the “Apply coupon” button. Check your details again and click “Place order.” You will then receive an order confirmation via email. The invoice will be sent separately after your order is prepared. You can pay the invoice by bank transfer. The order will be dispatched once payment has been received in our bank account.
3) Please complete the information and confirmation page carefully, as the accuracy and correctness of the data directly affect the prompt and error-free delivery of your purchased products and the resolution of potential disputes.
4) Orders placed in the Online Store are processed Mon–Sat 12:00–18:00. Orders submitted on Saturday after 14:00 will be processed on the following Monday.
5) The Online Store is entitled to withdraw from the contract or refuse to deliver a product if the item is out of stock or displayed incorrectly due to a system error. If a Client’s ordered product is unavailable, the Company will cancel the order either partially or fully. The Client will be informed immediately of any cancellation. In the case of partial cancellation, the Company may ask how the Client prefers to proceed with the remaining items—whether to ship them or cancel the entire order.

4. ENTRY INTO FORCE OF THE SALES CONTRACT

1) Under the sales contract, the Online Store undertakes to deliver the goods to the Client and enable the transfer of ownership, and the Client undertakes to pay the amount stated on the invoice and accept the goods.
2) The sales contract enters into force once the Client’s payment has been received in the Online Store’s bank account.

5. DELIVERY

1) After the sales contract enters into force, the Online Store will prepare the order within two working days and hand it over to the logistics partner chosen by the Client. Once handed over, delivery to the parcel machine will take 1–3 working days.
2) The Client will be notified of the arrival of the order either by the logistics partner (if delivered to a parcel machine) or by Finostilo OÜ (if delivered to the SPEKTER store). In the latter case, the Client will receive an email notification to the address provided.
3) The delivery times shown on the Online Store website apply from the moment the order payment is received.
4) To avoid delivery delays, the Client must ensure that the information provided during checkout is accurate and up to date.
5) The Online Store is not liable for delivery delays caused by circumstances beyond its control once the goods have been handed over to the logistics partner on time.

6. RIGHT OF RETURN

1) After receiving the order, the Client has the right to withdraw from the contract concluded in the online store within 14 days without giving any reason.
2) The Consumer is liable for any decrease in the value of the item if it has been used in a way other than necessary to determine the nature, characteristics, and functioning of the item. To inspect the nature, characteristics, and functioning of the item, the Consumer may handle and use the item only as permitted in a physical store.
3) To return the goods, the Client must submit a withdrawal request by email to info@spekter.eu within 14 days of receiving the goods.
4) The Client must return the goods within 14 days of submitting the withdrawal request or provide proof that the goods have been handed over to a postal service using a registered method. The Company may withhold refunds until the returned goods are received or proof of shipment is presented.
5) Upon receiving the withdrawal request, the Online Store will refund all payments received under the contract, including delivery costs (except when the Client chose a more expensive delivery method than the standard offered), within 14 days.
6) The Client bears the cost of returning the goods.

7. FORCE MAJEURE

1) The Online Store is not liable for damage or delivery delays if they are caused by circumstances beyond its control or unforeseeable events.

8. PROCESSING OF PERSONAL DATA

1) By entering their data in the Online Store and confirming the action, the Consumer grants permission to collect and process their personal data (name, phone number, delivery and/or home address, email address) for the following purposes:

  • Only to the extent necessary to provide the requested service and to forward the data to logistics partners for delivery of goods
  • When subscribing to the newsletter. The newsletter is sent using the MailChimp platform

2) The Consumer has the right to request details about the personal data collected about them, to request corrections, to object to data processing or demand restrictions, and to request access, deletion, or transfer of their data. To access this information, please contact us at info@spekter.eu.
3) The Consumer has the right to prohibit the collection and use of their personal data at any time, except where it is necessary for fulfilling contractual obligations or for delivery. Certain personal data may be retained in the Company’s records or archives as required by law, but such data will not be used for commercial purposes.
4) We do not retain your personal data longer than necessary for the purpose for which they were collected. Data will be deleted from our systems once they are no longer needed.
5) Encrypted data communication with banks during payment ensures the security of the Consumer’s banking credentials, which are not accessible to the Online Store.

9. PROCEDURE FOR SUBMITTING COMPLAINTS

1) The Online Store is liable for non-conformities or defects of the goods sold that appear within two years from the date of delivery to the Client.
2) The Client must contact the Online Store within two months of discovering a defect and present the invoice for the purchase.
3) If a defect appears, please stop using the product.
4) The Online Store and the Client will agree on repair or replacement of defective goods. Repair costs are covered by the Online Store.
5) The Online Store is not liable for defects caused by improper storage or misuse of the product by the Client.
6) To submit a complaint, please send an email to info@spekter.eu indicating the name of the orderer, contact phone number, order number, and a detailed description of the defect or non-conformity.
7) Complaints must be submitted within two months of discovering the defect.
8) All complaints will be reviewed, and the Client will be contacted as soon as possible, but no later than within 14 days of receiving the complaint.
9) The Client has the right to request a price reduction or termination of the contract and a refund if repair or replacement is impossible, if attempts to repair or replace fail, if the Online Store does not remedy the defect within a reasonable time, or if unreasonable inconvenience is caused to the Client.

10. THE CLIENT’S RIGHT TO APPLY TO THE CONSUMER DISPUTES COMMITTEE

1) If the Online Store refuses to resolve the Client’s complaint or if the Client does not agree with the proposed solution and believes their rights have been violated, they may submit a complaint to the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority or take the matter to court. The Consumer may file the complaint personally or through a representative. Information about the Consumer Disputes Committee is available on the Consumer Protection Authority’s website. For disputes within the EU, the Consumer may contact the European Consumer Centre.
